The Chhattisgarh High Court ruled that private religious bodies such as Sharia courts or Dar-ul-Qaza lack legal authority to dissolve marriages or issue binding orders affecting marital status. The verdict came in a case filed by Nirosh Abbasi, challenging a 2022 order from the Idara-E-Shariya Islami Court in Raipur declaring her divorced. The court emphasized these bodies can only offer religious guidance and cannot substitute statutory courts. It also noted that religious opinions cannot override legal processes, especially when civil proceedings are ongoing.
